Regulation 31. Offences and penalties.
(1) Subject to subregulation (2), a person who contravenes
any provision of these Regulations shall be guilty of an offence.
(2) A person who contravenes any provision specified in column (1) of the Second Schedule shall be guilty of an offence and shall, on conviction, be liable to a fine of not less than the amount prescribed in column (3) of the Schedule. (3) Where a person is convicted under regulation 4, 10,
14, 15, 16, 18, 19, or 24 and it is proven to the satisfaction of the
court that damage has been caused to the railway, railway premises or
station due to an act of that person, the court may, without prejudice
to the power of the court to order a fine under subregulation (2), make
an order for that person to pay to the railway company such amount of
costs or compesation as the court deems fit. |
